1. About these terms
These Terms of Service are the agreement between you and KelpieMC Network ("KelpieMC", "we"), which runs the website kelpiemc.org, the Minecraft network play.kelpiemc.org and the store. By creating an account, joining the servers or buying from the store you accept these terms and the Rules of the Realm, which are part of them. If you do not agree, please do not use the services. How we handle personal data is explained in the Privacy Policy.
2. Who we are and how to reach us
The services are provided by KelpieMC Network, [not provided yet], VAT number [not provided yet]. Single point of contact for users and for authorities under the EU Digital Services Act (articles 11 and 12): [email protected]. You can write to us in any language; we answer in English or Italian. For questions about personal data write to [email protected].
3. Accounts and age
You must be at least 14 years old to create an account. If you are under 18, make sure a parent or guardian knows that you use the services, especially before you buy anything. Give true information when you sign up: your date of birth is used only to check the minimum age. Keep your password and two-step codes private: you are responsible for what is done with your account. One person, one account: do not share, sell or buy accounts. Staff will never ask for your password.
4. Rules of conduct
You agree to follow the Rules of the Realm on the website, on the forum, on Discord and in game. In particular, do not cheat or use unfair modifications, exploit bugs, harass or threaten other people, impersonate staff, spam or advertise, share other people's personal data, or post illegal content, sexual content, hate speech or anything that can harm minors.
5. Moderation
To keep the community safe we moderate content and behaviour with these tools: • an automatic filter that checks threads, replies, comments, private messages and tickets against lists of blocked or suspicious words and spam patterns; it can stop a message or hold it for review, and every held message is decided by a member of staff; • reports from members and, through the public report form, from anyone; • review by the staff team, who can edit or remove content, lock threads, restrict forum access (mute or suspension) and apply in-game sanctions as described in the Rules. When we remove your content or restrict your account we tell you what we decided, why, which rule or law it is based on and whether automatic tools were involved. Sanctions are proportionate to how serious and how frequent the violation is.
6. Contesting a decision
If you think a moderation decision is wrong, open a ticket in Support or write to [email protected] within six months, explaining why. Whenever possible the case is reviewed by a member of staff who was not involved in the original decision, and you receive the outcome with its reasons. You can also turn to the competent authorities or courts at any time.
7. Reporting illegal content
Anyone, even without an account, can report content they believe is illegal through the form on the Report page: give the link to the content, explain why it is illegal and confirm that the report is made in good faith. You receive a case number and, later, our decision with its reasons. Reports of cyberbullying are handled first: we take them in charge within 24 hours and, when the report is founded, remove the content within 48 hours (Italian Law 71/2017). If someone's life or safety is in danger we inform the authorities.
8. Your content
You keep ownership of what you post. You give KelpieMC Network a free, non-exclusive licence to host, show and adapt it (for example to resize an image) on the website, on the servers and on our social channels while it is published. Only post what you have the right to share. If you delete your account, your threads and posts stay visible signed as "Deleted user", so that discussions keep making sense. You can delete single posts before that, or ask us to remove a post that contains your personal data.
9. Purchases
The store works through Tebex Limited (United Kingdom), which sells the items and handles the payment: the checkout terms of Tebex shown before you pay apply to the payment, the receipt and refunds. Prices include VAT where it applies, and a crossed-out price is the lowest price of the previous 30 days. Items are delivered to the Minecraft name you enter at checkout, so check it carefully. Ranks, gems and other items are digital content delivered right away: by asking for immediate delivery you agree that the 14-day withdrawal period ends when delivery starts, as EU law allows. This does not affect your rights if an item is not delivered or does not work: in that case open a ticket in Support.
10. Gems and virtual items
Gems, ranks and cosmetics have no monetary value, cannot be exchanged for real money and cannot be sold or transferred outside the network. We may rebalance game features, but we do not take away a paid item without a valid reason (such as a rule violation or a legal requirement), and if a paid feature is discontinued we offer a fair alternative.
11. Suspension and closing your account
We can suspend or close accounts that seriously or repeatedly break these terms, following the steps described in Moderation. You can close your account whenever you want from Account › Security › Delete account: it is deleted after 14 days, during which you can change your mind. On the same page you can download a copy of your data.
12. Availability and liability
We do our best to keep the services online and safe, but they can be interrupted for maintenance, faults or reasons beyond our control, and game progress can occasionally be lost. Within the limits allowed by law we are not responsible for indirect losses. Nothing in these terms limits liability for intent or gross negligence, or your rights as a consumer. KelpieMC Network is not affiliated with or endorsed by Mojang AB or Microsoft. Minecraft is a trademark of Mojang AB, and playing it also means accepting the Minecraft EULA.
13. Applicable law
These terms are governed by Italian law. If you are a consumer living in another country, you keep the protection of the mandatory rules of your country and you can bring a case before the courts of the place where you live.
14. Changes to these terms
We may update these terms when the services or the law change. For important changes we publish a notice and ask you to accept the new version the next time you visit while signed in: until you accept you can still read the website, download your data or delete your account, but you cannot post, open tickets or apply to the staff.
